HOUR OPT OUT AGREEMENT

DEFINITIONS

In this Agreement the following definitions apply:-

“Assignment”	means the period during which the Worker is engaged to render services to the Client;
“Client”	means the person, firm or corporate body engaging the services of the Worker;
“Employment Business”	means Synergy CRS Ltd
“Temporary Worker”	means The name on the front of this application form
“Working Week”	means an average of 48 hours each week calculated over a 17-week reference period.

References to the singular include the plural and references to the masculine include the feminine and vice versa. The headings contained in this Agreement are for convenience only and do not affect their interpretation.

RESTRICTION

The Working Time Regulations 1998 provide that the Temporary Worker shall not work on an Assignment with the Client in excess of the Working Week unless s/he agrees in writing that this limit should not apply.

CONSENT

The Temporary Worker hereby agrees that the Working Week limit shall not apply to the Assignment.

WITHDRAWAL OF CONSENT

The Temporary Worker may end this Agreement by giving the Employment Business 1 months notice in writing.

For the avoidance of doubt, any notice bringing this Agreement to an end shall not be construed as termination by the Temporary Worker of an Assignment with a Client.

Upon the expiry of the notice period set out in clause 4.1 the Working Week limit shall apply with immediate effect.

THE LAW

These Terms are governed by the law of England & Wales and are subject to the exclusive jurisdiction of the Court of England & Wales

I understand that any variation against what I have declared or provided, and any invalid documents provided or any false statements made as to the current status of my driving licence may result in Synergy CRS Ltd reporting my activity to the police and terminating any contract I hold with Synergy CRS with immediate effect. I authorise Synergy CRS Ltd to carry out any necessary checks required with the DVLA or any other governing body to ascertain the status of my driving licence.

I understand that the certificate will be sent to Synergy CRS Ltd whom will then forward to the address provided on this application form.
- For the Company to process my data with third parties including Recruitment and Employment Confederation if required also for internal audits and investigations carried out on the Company to ensure that the Company is complying with all relevant laws and obligations.

WORKER ON ASSIGNMENT – FIVE YEAR REFERENCING CHECK SHEET
It is a requirement of a majority of our clients, that all candidates who accept an assignment with us supply full details of previous employment history for the last 5 years.

All assignment offers are conditional on the receipt of satisfactory references from your previous employers.

DATA PROTECTION
The Data Protection Act 1998 (“the Act”) and the General Data Protection (2018) sets out certain requirements for the protection of your personal information against unauthorised use or disclosure.

Synergy CRS Ltd Workforce Agreement
This Agreement is between Synergy CRS Ltd "The Company" and {formWorkerName} "The Worker" in accordance with the provisions of the Road Transport (Working Time) Regulations 2005 [SI 2005/639 - "the Regulations"], which came into force on 4 April 2005 and will apply to those mobile workers subject to the provisions of the Regulations.

The Agreement will apply to the herein named worker as part of an agreement applying to all workers placed on and / or accepting assignments offered by Synergy CRS Ltd

It is agreed that the Company and the Workers will adopt the flexibility permitted by the Regulations as set out below.

This Agreement will remain in force for a period of 5 years when it will cease to have effect.

Reference Period: the reference period for the calculation of average weekly hours shall be as follows:

- extended to 26 weeks

And will have the following start and finish dates 18th May to 17th November and 18th November to 17th May

Night Work: a night worker's normal hours of work may exceed the limit of 10 hours in each 24 hour period.
Vehicle Usage Disclaimer
I, {formWorkerName}, Understand that, when assigned in any location, I may be issued a vehicle to carry out the duties required.

I understand that the vehicle may be offered to me for the purposes of commuting to and from my allocated hub, along with delivery duties whilst on assignment. I further understand that all vehicles are tracked and traced and the vehicle location will be known at all times.

I have been made aware by Synergy CRS Ltd that the vehicle MAY NOT BE USED, under any circumstances for any of the following;
1. Driving to and from assignments allocated to me by Synergy CRS Ltd unless allocated an assignment
2. Any form of personal use, including personal travel and any travel apart from travel to and from work locations, transferring between hubs when on assignment or when carrying out delivery duties on assignment
3. Use the vehicle to carry out assignments for and on behalf of any client I am assigned to by Synergy CRS Ltd with the exception of the client who has issued the vehicle
I have been briefed on the vehicle allocation rules by Synergy CRS Ltd and understand that should I be found to have not adhered to these rules, my assignment will be terminated with immediate effect.

I confirm that all tachograph charts, downloads and client property will and shall be given to the client I am placed on assignment with, within the clients individual parameters for downloads and return of tachos, and I understand that at all times the clients individual requirements and procedures for tacho return, as long as are legal, supersede the tachograph legislation. Furthermore, I understand and agree that my pay may be delayed or withheld by Synergy CRS Ltd until tachos are downloaded or returned to the appropriate client, or Synergy CRS Ltd.
Terms & Conditions
Employment businesses’ terms and conditions with work-seekers

Before can begin looking for work for you, we have to agree terms and conditions with you (the Work Seeker). Please read below and tick the box to confirm your agreement to these terms;
1. We operate as an employment business and we will seek assignments for you mainly in the industrial (Warehouse) and logistics (Driving) sector, which best suits your skill set and experience.
2. Once an assignment is found for you, you will be informed of the type of contract you would be working under. This may be contract for services or an employment contract with another provider.
3. You will be paid for all work as agreed, even if the end user does not pay the employment business
4. You will normally be given a minimum one day’s notice to start an assignment, no notice is required by either party to end an assignment.
5. Pay rates will vary to each assignment, however will never be lower than the national minimum wage and full details will be provided on the assignment details form.
6. You will be paid weekly, each Friday, anytime between 00:00hrs and 23.59hrs
7. You are entitled to statutory holiday pay at your normal rate of pay.
8. I confirm that I am aware that if I do not declare my previous working history for a Synergy CRS client my AWR information will not be up to date and this may delay my parity payments.
9. The agency is willing to bare the cost of your DBS check which is currently £ 29.00. However, if you were to leave the assignment, for any reason, within 8 weeks of commencing, then you agree the agency has the right to reclaim the amount of the DBS check via a deduction from your final wage via your payroll intermediary/employer.
10. By signing this document you agree that you understand that you are not an employee of Synergy CRS, and that you are a temporary worker on assignment as a contractor for a third party employer. This was also outlined in the job advertisement you applied to, and also explained during the interview process.
